INTELLECTUAL PROPERTY RIGHTS
Intellectual property rights are trademarks, patents, designs, geographical indications and utility models, copyrights.
The development of industrial rights has been parallel to its national and international development. Increasing international competition, rapid growth of economies and rapid change in people's consumption habits day by day have increased the need for both national and international protection of industrial rights. For example, if we consider trademark protection, a brand is defined as a sign that serves to distinguish the products or services of one trader from the products or services of other traders. Essentially, the signs used by commercial actors such as tradesmen and merchants in their products and services benefit from unfair competition protection, but the trademark protection that comes with registration in the trademark registry provides much stronger protection than unfair competition. With this protection provided, traders will be able to distinguish their products from other traders' products and prevent unfair profits from being imitated. In other words, it will protect the functions of its brand and prevent infringement.
Provisions regarding industrial rights are basically found in the Industrial Property Law. The law contains five books, starting from the initial provisions and the trademark. The common provisions section, which is the fifth book, includes common provisions applicable to all industrial property rights such as deadlines, compensation, jurisdiction.
Copyrights cover information, works of art and designs created by people through all kinds of labor, work and efforts. These can even be the design of a book, painting or sculpture.
There are points where industrial rights and copyrights coexist or are separated by clear boundaries. For example, if a design bears the characteristics of its owner and has the characteristics that the law attributes to the design, it can both be the subject of the person's copyright and, if desired, benefit from registered design protection by applying for a design.
